A. For the case of Reginald LITTLE MAN .-
What dated 19 June 2001, Sir Reginald Little Man has been appointed to Clerk position in the service of that social institution (reference appointment letter No. DG/19835)
What dated 1 st July 2003, he was promoted with CONGRATULATIONS to the position of Assistant Head of Service Relationships Public Institution (reference to the appointment letter No. DG/25684)
until February 2007, a union appointed Trade Union of Employees of ONA, SE -ONA, Eight Hundred (800) members has been created at the initiative of a group of workers and employees of the ONA pour défendre les droits et intérêts desdits employés ;
Qu’au mois d’Aout 2007, ce syndicat a été régulièrement enregistré au Numéro : STC-06192 et autorisé de fonctionnement par la Direction du Travail du Ministère des Affaires Sociales et du Travail ;
Que dans une Assemblée Générale ordinaire, en date du 4 Aout 2009, Reginald PETIT HOMME a été réélu Président avec un mandat de quatre (4) ans ayant pour mission de défendre les droits et intérêts de tous les employés of that institution;

What dated April 12, 2010, a copy of correspondence from the Ministry of Social Affairs was sent to the applicant by way of notification;
until April 2010, following representations by the trade unionist, as a defender of rights and workers' interests with the Minister of Social Affairs and Labour, on the possible dismissal of 500 employees of the NFA, the then Minister, Yves CRISTALINE in a Note Ministerial addressed to ; all CEOs who are under the guardianship of that Department, in part, of your restraining them from any revocation, on the ground is that the post-earthquake is very vulnerable to workers;

What dated February 21, 2002, the Sir Joseph John Chenier, Secretary Executive Staff Union of Employees of ONA, was appointed to the Screening Service of that institution by an appointment letter with reference to: DG/21832
What dated 03 June 2002, he was promoted to Inspector Inspection Service by letter of assignment from the reference DG/22834;
What dated June 14, 2002, it was confirmed in office by a letter from the office of Division of Control and perception of NFA
that on August 5 2003 he was reassigned to the position of General Trace through correspondence with the reference DG/26192;
What dated April 29, 2004, he was laid off ground that has been forced budgetary
What dated July 12, 2004, he was reinstated to his position as Scout through correspondence with the reference DG/30215;
What dated June 25, 2007, he was promoted to Scout through a letter of promotion with reference DG/38016;
What dated September 16, 2008, he was promoted to Inspector Intermediate to Supervisor Inspector from a promotional letter referenced to DG/43182;
That was his great astonishment, April 26, 2010, he was fired from his duties following an investigation report on an issue of suspected fraud in the collection of contributions Your Branch;

Que dans les conclusions et recommandations dudit rapport d’enquête, seul le nom de l’inspecteur Dépisteur Edouard SAINT GERMAIN a été cité pour violation de la loi dit-on de la discrétion , (Page10, 6 paragraphe) ;
Que selon les dernières recommandations des enquêteurs, après avoir cité les noms, prénoms et les responsabilités de chacun en ce qui leur concerne, demanded to your Directorate outright acquittal of all the employees laid off;

Rappelant que le Code du Travail en ses articles 225 et suivants stipule que le droit des travailleurs de créer et de s’associer avec des syndicats pour la défense de leurs LEGITIMES INTERETS est GRANTI et protégé par l’ETAT et donc, la LIBERTE syndicale est d’ordre publique ;
Rappelant que la Déclaration Universelle des droits de l’homme, en ses articles 23 et suivants stipule que : Everyone has the right to form, to associate and to exercise the right to organize with the goal of defending the rights and interests of workers;
Recalling that the International Covenant Covenant on Economic Social and Cultural Rights in its Article 8 states that: States Parties to the present Covenant undertake to ensure: a.
- The right of everyone to form trade unions and s affiliated to other purposes to defend their rights and interests;

Par ces causes et motifs, NOUS, les Organisations des droits et dignite de la Personne humaine, les Syndicats et organisations des travailleurs signataires de la présente Pétition : Action des Unités Motivées pour une Haïti de Droit, AUMOHD, Centre Américain de Solidarité avec les Travailleurs FLA-CIO, Enten Sendikal Premye Me Batay/Ouvriye, Mouvement des Organisations Indépendantes Intégrées aux Syndicats Engagés, MOISE , Organisation Générale Indépendante des Travailleurs Haïtiens, OGITH. - avec les deux (2) Syndicalistes Victimes signataires en vertu de tout ce qui précède, demandent à votre Direction de l’Office National d’Assurance Vieillesse, ONA, et au Ministre des Affaires Sociales et du Travail, Son Excellence Gerald GERMAIN ceci, à votre diligence conjointe :
